18 U.S.C. § 2257 Record-Keeping Requirements Compliance Statement
All persons appearing in any visual depiction on Peek were at least 18 years of age at the time the depiction was created. Peek does not permit anyone under 18 to hold an account, appear in content, or access the Service.
1. Exemption statement
Peek Entertainment, LLC (“Peek Entertainment”), the operator of Peek (https://peek.social), is not the producer, whether primary or secondary, of any visual depiction of actual or simulated sexually explicit conduct that may appear on the Service. All content on Peek is created, uploaded and published by independent, third-party content creators who have completed age and identity verification.
Peek Entertainment’s activities with respect to such content are limited to the transmission, storage, retrieval, hosting, formatting and display of communications, without selection or alteration of the content other than as directed by the creator (for example, applying the creator’s chosen audience level, blurring a creator’s “Sneak Peek” teaser, or resizing for display) and other than the deletion of content that violates our Terms or the law. Accordingly,Peek Entertainment is exempt from the record-keeping requirements of 18 U.S.C. §§ 2257 and 2257A pursuant to 28 C.F.R. § 75.1(c)(4).
Much of the content on Peek is not sexually explicit conduct as defined in 18 U.S.C. § 2256(2)(A) and is therefore outside the scope of § 2257 altogether. This statement is provided so that our position is clear for all content regardless of category.
2. Creator (producer) obligations
Each creator who produces content depicting actual or simulated sexually explicit conduct is the “producer” of that content under 28 C.F.R. § 75.1(c) and is required, as a condition of our Terms of Service, to:
- Verify, by examining a valid government-issued photo identification, that every person depicted was at least 18 years old at the time of creation;
- Obtain and keep each depicted person’s written, informed consent to be depicted and to the distribution of the content on Peek;
- Create and maintain the individually identifiable records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 (including a legible copy of the identification, legal name, any aliases or stage names, and the date of production), cross-referenced to each piece of content;
- Make those records available to Peek Entertainment within 48 hours upon request, and to the Attorney General as required by law; and
- Include their own § 2257 compliance statement and custodian-of-records information on any content they produce that is subject to the statute, where required.
Peek Entertainment independently verifies the age and identity of every creator through a third-party verification provider before creator tools are enabled, re-verifies where warranted, and removes content and terminates accounts where records are not produced or where any depicted person cannot be confirmed to be an adult.
3. Content produced by Peek Entertainment
Peek Entertainment does not currently produce sexually explicit content. Should Peek Entertainment ever act as a primary or secondary producer of any depiction subject to 18 U.S.C. § 2257, the records required by 28 C.F.R. Part 75 for that content will be kept by the Custodian of Records at the following location and will be made available for inspection during normal business hours as the statute requires:
